Initial Assessment

A case handler will undergo a brief telephone consultation to assess a few key facts to establish the likelihood of you having a successful claim, this should take only few minutes. At this stage we can quite quickly identify cases that can be successful and how many types of claim that you may have. We will also identify the possible course of action(s) open to you, what the likelihood of success may be, timescales involved and also answer any questions that you may have. We provide a clear picture in order that you can reach an informed decision as what steps to take if any. This advice is FREE and Unconditional.

Consultation & paperwork Review

Once we have received your completed forms one of our case advisors will contact you at a mutually convenient time to discuss your case and assess your options. To do this, they will also need copies of any paperwork you may still retain and will advise you of any further paperwork that is key to your case.

The Assessment is an easy process where we are looking to establish a few key facts. Some of these facts will include key dates of your purchases, what you were told and what your experiences were and any supporting documentation that you may have. Once we have all the facts, we can then recommend the best Course of Action(s) for you. This assessment will form the basis of our legal argument and consequently allow us to establish what the best option or options that can be pursued for you.

Recommended Course of Action(s)

There are a number of options detailed below that can be taken dependent on the type of claim to be made and key facts gleaned from our assessment. There are very different pros and cons regarding the following courses of action, some of the variables are the amount you can claim for on a particular type of claim and the time it may take to conclude, to name but a few. Rest assured, we will advise you as to what options are open to you and the likelihood of success, including costs and timescales regarding the following;

  • Consumer Credit Act 1974 (CCA) Claim
  • Financial Ombudsman Service (FOS) Claim
  • Financial Services Compensation Scheme (FSCS) Claim
  • UK Court Action Claim

We will advise you as to the best course of Action and the amount we expect to claim.

Once you have provided the information above, we will prepare and manage the entire process for FOS, FSCS in-house, making it a hassle-free process. If it is determined that the best course of Action is to engage one of our specialist Law firms, we will prepare all paperwork and then once you have engaged the Law Firm directly, they will handle all aspects of your case from there on in, again removing the day to day running and hassle from you.

RELINQUISHMENT WARNING

Some companies claim to have relinquished your Timeshare product; you may also have had a letter from the Resort stating this has been done. However, unless this has been ‘notarised’ in the courts in Spain this cancellation may not stand up to a LEGAL CHALLENGE. You could find that you still own the Timeshare and may receive a bill many years in the future for unpaid Maintenance Fees for previous years.
